New California Bill Could Benefit Hit-and-Run Accident Victims

On March 19, a new bi-partisan state bill will be heard in the Assembly Public Safety Committee. The bill, if passed, could potentially amend a state law that benefits DUI drivers who are able to have a shorter prison sentence after a  hit-and-run accident.

What Will This New Bill Change for Hit-and-Run Victims?

The bill is called “Gavin’s Law,” named after Gavin Gladding who was killed in a hit and run accident last year in September. The driver responsible for the crash, Rogelio Alvarez Maraville, only received a three-year prison sentence for the felony crime. Maraville and two other passengers fled the scene, and allegedly tried to cover up evidence at the scene. Maraville was arrested five days later, which made it impossible for law enforcement to know if he was under the influence at the time of the crash. If it could have been proven that Maraville had been under the influence at the time of the crash, his prison sentence would have been at least 15 years under a second-degree murder conviction.

Under the current California law, the maximum punishment for a hit-and-run accident that caused a serious injury or a fatality is four years in prison. However, most hit-and-run drivers flee the scene, which allows them to sober up and hide evidence. They are able to avoid DUI charges and any other charges or sentencing.

“Gavin’s Law,” formally known as AB 582, will increase the penalties for hit-and-run accidents in California. Penalties include four to six-year prison sentences for accidents that caused “great bodily injury,” and six to eight years for accidents resulting in death.
